When using our services, including our WhatsApp Business messaging, you agree not to:

• Send spam, unsolicited bulk messages, or content unrelated to the purpose you provided your contact details for
• Send or request illegal, fraudulent, abusive, or harmful content
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use our services in any way that violates applicable law or infringes the rights of others

We reserve the right to suspend or terminate access to our services for anyone who violates these terms.

For paid client engagements (such as digital marketing, software development, or branding projects), specific pricing, deliverables, timelines, and payment terms are agreed separately in writing (via proposal, invoice, or contract) between DigiSpark and the client. Those agreed terms govern the engagement in addition to these Terms. Unless otherwise agreed, payments are due as specified in the applicable proposal or invoice.

All content, trademarks, and materials on our website and marketing materials are the property of DigiSpark or its licensors, unless otherwise stated. Deliverables created for clients as part of a paid engagement are governed by the terms of the applicable project agreement.

Our services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, DigiSpark shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. Our total liability for any claim arising from our services shall not exceed the amount you paid us, if any, for the specific service giving rise to the claim.

Our WhatsApp Business messaging services rely on Meta's WhatsApp Business Platform. Your use of WhatsApp is also subject to WhatsApp's own terms and policies. We are not responsible for the availability or performance of third-party platforms we integrate with.

7.1 B2B Social Media Agency & Software Limitation (Healthcare Vertical)

DigiSpark AI Solutions & Marketing operates strictly as a B2B Digital Marketing Agency and Software Provider. For our clients in the healthcare sector (including hospitals, doctors, and clinics), we provide social media management, lead generation marketing, and administrative automation software (such as appointment scheduling engines and review managers).

No Medical Data Processing: Our software platforms, CRM integrations, and Meta Cloud API webhooks are not intended, designed, or authorized to store, transmit, or process sensitive patient health records, diagnostic files, medical histories, or prescriptions.

Client Responsibility: Healthcare clients using our software tools are solely responsible for ensuring that their automated marketing workflows comply with local healthcare advertisement laws and do not collect unauthorized medical information from users.

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Sagar, Madhya Pradesh, India.
